Your privacy is very important to Winc Academy B.V. (hereafter: Winc Academy). In this statement you can read how we collect, process, secure and store your data in accordance with the General Data Protection Regulation (AVG). This means that:

• Store as little personal data as possible and only the data necessary for our purposes;
• Explicitly request permission to process your personal data, should consent be required;
• Take necessary security measures to protect your personal data. We also impose these obligations on parties who process personal data for us;
• Respect your rights, such as the right to access, correct or delete your personal data processed with us.

Good to know is that Winc Academy does not use automated decision making. And that in no case is special and/or sensitive personal data requested.

For what purposes do we use your personal data?

Winc Academy processes personal data for the following purposes:

• Enrollment and Guidance: Processing enrollments and providing personalized guidance during training.
• Accessing the online learning environment: Managing accounts and progress information.
• Certification: sharing achieved results with the certification partner for issuance and verification of certificates.
• Administration and billing: Processing payments, purchases, study periods, progress and any data exchange with grant partners (if applicable and so agreed).
• Quality improvement: analyzing data to improve the learning experience and service. Where possible, we anonymize this process.
• Marketing and Communications: Sending personalized messages after consent, such as follow-ups on webinars, updates on training and other relevant information.
• Legal obligations: Sharing progress or other relevant data with grant partners, such as UWV or municipalities, if contractually or legally required.

Application for or orientation to training

Through our website www.wincacademy.nl you can sign up for one of our courses, more information, orientation tests or events, such as a free webinar.

For this purpose, depending on your interaction with us, we process the following data:

• NAW data
• Phone number
• Email address
• Correspondence
• Data and results from any testing
• Company name

This information helps us to offer you the right training and prepare for a possible agreement. Contact information will only be used for further follow-up if you have given permission to receive marketing communications.

Aanmelden voor opleiding

‍

Als je je aanmeldt voor één van onze opleidingen, verwerken wij de volgende persoonsgegevens:

‍

• de gegevens die je hebt opgegeven bij de aankoop van de opleiding, waaronder je voor- en achternaam, e-mailadres, adresgegevens, betaalgegevens en de gekozen opleiding;
• gegevens over de startdatum van je opleiding en de bijbehorende studiedeadline;
• betaal- en factuurgegevens;
• gegevens van je werkgever of subsidieverstrekker (indien je de opleiding via of samen met hen afneemt). Deze gegevens worden door jou of door de betreffende werkgever of subsidieverstrekker aan ons verstrekt. Wij verzamelen deze gegevens niet zelfstandig;
• eventuele correspondentie tussen jou en Winc Academy, bijvoorbeeld via e-mail.

Wij verwerken deze persoonsgegevens om de overeenkomst die wij met jou aangaan uit te voeren. Op basis van jouw aanmelding maken wij een uitnodiging aan voor een persoonlijk account in onze online leeromgeving (LearnAmp). Je ontvangt hiervoor een uitnodiging per e-mail. Het account wordt pas actief nadat je deze uitnodiging accepteert en akkoord gaat met de geldende voorwaarden en privacyverklaring van LearnAmp. Je kunt deze voorwaarden hier vinden, maar ook wanneer je een account maakt of zal inloggen op het platform. De verwerking van deze gegevens is noodzakelijk om onze onderwijsdiensten als online opleider te kunnen leveren.

Deelnemen aan opleiding in de leeromgeving

Nadat je je hebt geregistreerd en je de uitnodiging voor de leeromgeving hebt geaccepteerd, kun je inloggen op jouw persoonlijke account in onze online leeromgeving. Via dit account heb je toegang tot het lesmateriaal van je opleiding(en), kun je je studievoortgang en studieactiviteit volgen en vind je de verschillende opties voor begeleiding.

Winc Academy is een volledig online opleider. Om onze opleidingen te kunnen aanbieden, maken studenten gebruik van een persoonlijke online leeromgeving. Deze leeromgeving wordt aangeboden via LearnAmp, een externe leeromgeving (Learning Management System – LMS). Bij het accepteren van de uitnodiging en het gebruik van de leeromgeving ga je akkoord met de privacyverklaring en gebruiksvoorwaarden van LearnAmp. Deze voorwaarden zijn beschikbaar via LearnAmp en worden ook getoond bij het aanmaken van een account en bij het inloggen op het platform.

Met behulp van jouw account verwerken wij persoonsgegevens over jouw studieactiviteit en opleidingsvoortgang. Het gaat hierbij concreet om:

• het moment van inloggen (datum en tijd);
• hoe lang je actief bent in de leeromgeving (studietijd in minuten);
• je opleidingsvoortgang (welke onderdelen zijn afgerond/waar ben je nu mee bezig);
• deelname aan online begeleidingsmomenten of evenementen (zoals 1-op-1 sessies of webinars);
• je naam, e-mailadres, opleiding en studiedeadline.

• taalvoorkeur en tijdszone
• door jou geüploade documenten (zoals opdrachten en projecten)
• onze feedback op jouw opdrachten en eindprojecten
• een eventuele profielfoto of andere informatie die je vrijwillig toevoegt aan je profiel (zoals een bio of berichten).

Wij verwerken deze gegevens om de opleidingsovereenkomst met jou uit te voeren en om je leerproces optimaal te ondersteunen. Deze verwerking is noodzakelijk voor het goed functioneren van de online leeromgeving en voor het leveren van onze onderwijsdiensten. Wij gebruiken deze gegevens onder andere om:

• je toegang te geven tot het juiste lesmateriaal;
• je studievoortgang bij te houden en je automatisch door te laten gaan naar volgende onderdelen;
• studiebegeleiding en coaching te kunnen bieden, bijvoorbeeld bij planning en voortgangsgesprekken;
• vast te stellen wanneer een opleiding succesvol is afgerond en een certificaat kan worden uitgegeven;
• inzicht te hebben in deelname aan begeleidingsmomenten waarvoor je je hebt ingeschreven, zodat ons team op de juiste momenten beschikbaar is.
  
  

Het vastleggen van studieactiviteit is vergelijkbaar met aanwezigheid in fysiek onderwijs en is noodzakelijk om jou adequaat te begeleiden en onze onderwijsdienst als online opleider te kunnen leveren.

Wij bewaren jouw persoonsgegevens zolang dit nodig is voor de uitvoering van de overeenkomst, het behoud van geldige certificaten en het mogelijk maken van heractivatie of vervolgopleidingen, tenzij je eerder verzoekt om verwijdering.

Marketing Communications

Winc Academy verstuurt nieuwsbrieven, marketingmails en andere vormen van marketingcommunicatie uitsluitend als je hiervoor expliciet toestemming hebt gegeven (opt-in). In deze communicatie kunnen wij je informeren over onze opleidingen, diensten, evenementen, brochures, testuitslagen of relevante aanbiedingen.

De verwerking van persoonsgegevens voor marketingcommunicatie vindt plaats op basis van jouw toestemming in de zin van artikel 6, eerste lid, onder a van de AVG. Deze toestemming wordt verkregen via onze formulieren, bijvoorbeeld bij het aanvragen van een brochure, het maken van een test of het aanmelden voor een webinar.

Je kunt je toestemming op ieder moment intrekken via de afmeldlink in elke e-mail of door contact met ons op te nemen via welkom@wincacademy.nl. Wanneer je je afmeldt voor marketingcommunicatie, verwerken wij jouw gegevens uitsluitend nog voor administratieve doeleinden of om te waarborgen dat je geen verdere marketingberichten van ons ontvangt, zolang je bij ons studeert of contact met ons hebt.

1. Webinars

‍

Winc Academy organiseert webinars om geïnteresseerden te informeren over onze opleidingen en baankansen. Deze webinars zijn gericht op personen die zich oriënteren op een opleiding bij Winc Academy. Aanmelding voor een webinar verloopt via onze website. Deelname aan een webinar is alleen mogelijk nadat je hiervoor expliciet toestemming hebt gegeven voor de verwerking van jouw persoonsgegevens zoals hieronder beschreven.

Bij aanmelding en deelname aan een webinar verwerken wij de volgende persoonsgegevens: voor- en achternaam, woonplaats, e-mailadres, telefoonnummer, het gekozen webinar en de datum & tijd van deelname en aanwezigheid.

Wij verwerken deze persoonsgegevens om het webinar te organiseren, uit te voeren en om contact met je op te nemen over het webinar, waaronder opvolging naar aanleiding van het webinar en informatie over onze opleidingen, diensten en evenementen.

De verwerking van persoonsgegevens in het kader van webinars vindt plaats op basis van jouw toestemming in de zin van artikel 6, eerste lid, onder a van de AVG. Je kunt deze toestemming op elk moment intrekken. Intrekking van toestemming heeft geen gevolgen voor reeds gevolgde webinars, maar kan betekenen dat je geen verdere communicatie van ons ontvangt.

Provision of personal data to third parties

We share your personal data with third parties only when permitted by law. We have entered into agreements with these third parties so that they maintain the same high standards of security and confidentiality as we do.

We may share your information with third parties for the following reasons:

• When necessary to perform the agreement with you
• When you have given explicit permission to do so
• When we have a legitimate interest
• When required by law (for example, in the case of a request from the police in connection with a criminal investigation)

The categories of parties with whom we may share personal data are:

• IT vendors and hosting parties
• Grant or funding partners (if applicable).
• Independent, hired teachers
• Your employer (if applicable)
• Cookie service providers

Deletion of data

We follow the following rules for retention and deletion of personal data:

• Students and alumni: data will be kept for as long as you are or have been attending a course with us. This allows us to validate certificates, support former students in further education and, upon request, reactivate an account in our learning environment without losing important data.
• Inactive accounts: If you are not or have not taken a course with us and are not signed up for our marketing activities, your data will be automatically deleted 5 years after the last activity.

Deletion upon request: You can request complete deletion of your data at any time by sending an email to welkom@wincacademy.nl. Please note that certain data, such as invoices and payment information, may not be deleted immediately due to legal retention periods.

Data processing outside the EEA

In order to provide our services, we use external systems and service providers. This may involve processing or storing personal data outside the European Economic Area (EEA). We only do this if there is an adequate level of protection, for example through European Commission model contractual clauses (such as with the UK) or other legally approved safeguards.

The 30-day period may be extended for reasons related to the specific rights of data subjects or the complexity of the request. If we extend this deadline, we will notify you in a timely manner. If we are unable to comply with your data, for example due to a legal retention obligation, we will also inform you in a timely manner.

‍Filing a complaint

At Winc Academy, we strive to provide the best learning experience for everyone. Nevertheless, it may happen that you are not satisfied. In that case, you can file a complaint according to the procedure below.

1. Filing a complaint

Send an e-mail to welkom@wincacademy.nl clearly describing your complaint.

• You will receive an acknowledgement of receipt within 2 weeks.
• Within 4 weeks of receiving the complaint, you will receive a substantive response.

2. Deferral of treatment

If we need more time to deal with your complaint, you will receive a notice with an explanation and the expected time for resolution.

3. Confidentiality and independent review
   
   • Your complaint will be handled confidentially.
   • The complaint will be handled within 6 weeks by an independent employee of Winc Academy.
4. Disagree with the outcome?
   
   • If you feel that your complaint has not been handled properly, you may contact the NRTO's Disputes Committee at www.degeschillencommissie.nl.
   • In cases that are privacy-related, you can contact the Personal Data Authority (AP) at www.autoriteitpersoonsgegevens.nl.
